Missouri Court of Appeals, Eastern District to Hold Docket March 19 at Southeast


Students, faculty, staff and community members are invited to attend the Missouri Court of Appeals, Eastern District, when it holds its Southern Division docket beginning at 9:30 a.m. March 19 at Southeast Missouri State University.

The oral arguments, which are open to the public, will be heard in Glenn Auditorium of Robert A. Dempster Hall. The docket begins at 9:30 a.m. with two cases. Students may ask questions from 10:30-11 a.m. A third case is set for 11 a.m. and a fourth for 11:30 a.m. Each case is expected to run about 30 minutes.

Four judges will be in attendance, including Chief Judge Lisa Page, who is a 1988 magna cum laude graduate of Southeast with a bachelor’s degree in political science. She was elected by the judges in the district to serve as chief judge. Page was appointed to the Court in December 2015 after serving as a Circuit Judge, a Family Court Commissioner and a municipal judge.

“I am proud to be a graduate of SEMO, and I am honored and look forward to bringing the Missouri Court of Appeals, Eastern District, to my alma mater to allow the students and public to see firsthand the important work of our Court,” Page said.

Along with Page, the other judges participating in the court session are Judge Mary Kathryn Hoff, Judge Philip Hess and Judge Roy Richter.

Judge Hoff was appointed to the Court of Appeals in 1995.  She previously served as a Circuit Judge for the City of St. Louis Circuit Court.  Judge Richter was appointed to the Court of Appeals in 2006 and previously served as an Associate Circuit Judge in Montgomery County from 1979 to 2006. Judge Hess was appointed to the Court of Appeals in 2013.  Previously, he practiced law in St. Louis in private practice.

The judges will sit in panels of three to hear oral arguments from attorneys involved in four cases appealed from circuit courts in Cape Girardeau, Madison and Ste. Genevieve counties. The Court has held dockets at Southeast on seven prior occasions.

From Ste. Genevieve County (9:30 a.m.):

  • State of Missouri vs. Doyle D. Edwards

From Cape Girardeau County (9:30 a.m.):

  • Russell B. Welty, Sharon A. Stanley and Linda K. Fulton vs. Terry Givens, as trustee of the Terry N. Givens Revocable Restated Trust Dated November 6, 2013 and Terry N. Givens.

From Cape Girardeau County (11 a.m.):

  • Gill Family Properties, LLC vs. Keith Smith Mechanical, LLC F/K/A Bootheel Mechanical

From Madison County (11:30 a.m.):

  • Stephens Cemetery, est. 1864, Inc., William Maurice Stephens, Ernest Jerry Stephens, Melvin Eugene Stephens, Steven Eugene Stephens, Jana Marie Cook and Marcia Diane Braswell, on their behalf and on behalf of other unnamed descendants of Gabriel Jones Stephens vs. Wilma Elizabeth Tyler.

The Missouri Court of Appeals, Eastern District is the state’s largest appellate court with offices in the historic Old Post Office in downtown St. Louis.  There are 14 judges on the court, which handles approximately 50 percent of the intermediate appellate caseload in Missouri.  Oral arguments are regularly conducted in St. Louis, Hannibal, Cape Girardeau and other locations in the Eastern District.
